Product Registration In Dubai

Because Dubai has become a truly global hub for trade and commerce, it is not uncommon for business entrepreneurs to manufacture or assemble products in the UAE. The United Arab Emirates has made it mandatory that any product needs to be registered with the authorities before it can be manufactured, advertised, sold or distributed in the country. Any product that is not manufactured, but imported too needs to be registered. This registration is also essential for export purposes, even if they are not marketed in the UAE.

Product registration is especially important when it comes to cosmetic products. The Consumer Products Safety Section of Dubai Municipality evaluates the safety of cosmetics when applied on the human body, skin, or hair. Testing standards also exist for health supplements and food products as well.

PROCESS

The first step is to establish your company and secure an appropriate Business License for the class of commercial activity. For instance, an industrial license would be mandatory for those companies into manufacturing, while a commercial license would be needed if the product is intended to be imported into the UAE from a foreign country.

In the second step, which involves product registration with the Dubai Municipality, you need to submit a sample to the Consumer Products Safety Section along with detailed product information regarding the ingredients. The Consumer Products Safety Section evaluates the sample and also sees if the product label you have supplied them is detailed enough for consumers to make informed buying decisions. Simultaneously, your application to the Dubai Municipality must also contain a copy of your Business License, which is why it is important to register your company first. Only then can you receive a Business License.

What is a Cosmetic Product?

It is important to know the legal definition of a cosmetic product. A cosmetic product is any formulation that comes into contact with any part of the outer body, including skin, nail, hair, teeth, lips, or one’s private parts. The cosmetic product could be applied with a view to reducing or changing body odour, cleaning or keeping in good condition the parts the cosmetic product is applied on, or perfuming them.

Examples of cosmetic products are soaps, skin whitening or fairness creams, anti-wrinkle creams, deodorants, perfumes, hair gel and other hair products, shaving creams / foam, make-up removal products, bath products like body oil and also other body gels / creams / lotions that are applied on the face, hands, or feet. This list is in no way exhaustive, but only indicative.

Once product registration is granted, it is valid for five years.

In case you are importing the product, you will also need to furnish a Health Certificate from the country of origin. The Health Certificate could be known by different names in various countries, but what it does is to certify that it is fit for human use. In some countries, a national certifying agency would be the highest authority in these matters, and this is what would be required. In other countries, state certifying agencies do the same thing in the absence of a national certifying agency. The Health Certificate needs to be duly attested by the UAE Embassy in that country before it can be submitted to the Dubai Municipality.

You will also need to submit a Certificate of Free Sales. This is issued by a national government agency and certifies that the product can indeed be legally exported out of the country. It may also be known as a Certificate of Export or Export Certificate.

For health products, you will additionally require a GMP Certificate. GMP stands for Good Manufacturing Practice and certifies that the health products were manufactured while adhering to exemplary standards.

The point of product registration in the UAE is to ensure that only quality products can be sold, keeping consumer safety in mind. Product registration can help you see to it that duplicate products with similar names don’t flood the market and spoil your hard-earned reputation.
